Healthy Hoohoo® e-Gift Card Terms and Conditions

These e-Gift Card Terms and Conditions ("Gift Card Terms") apply to the purchase, receipt, and use of Healthy Hoohoo® electronic gift cards ("e-Gift Cards"). By purchasing, accepting, or using an e-Gift Card, you agree to these Gift Card Terms and our other applicable policies, including our Terms and Conditions, Privacy Policy, Shipping Policy, and Refund Policy.

If these Gift Card Terms conflict with our general Terms and Conditions regarding an e-Gift Card, these Gift Card Terms control. Applicable law controls where it provides rights that cannot be waived.

1. About Healthy Hoohoo e-Gift Cards

Each e-Gift Card is issued electronically with a unique redemption code. It may be used only for eligible purchases from Healthy Hoohoo's online store at healthyhoohoo.com. An e-Gift Card is not a credit card, debit card, or bank account.

Unless expressly stated otherwise, e-Gift Cards:

• are denominated in U.S. dollars;

• may be used only through the Healthy Hoohoo online store;

• cannot be used to purchase another gift card;

• cannot be reloaded; and

• cannot be used through an unauthorized retailer, marketplace, or reseller.

2. Purchase and Payment

The purchaser must use an accepted payment method and provide accurate billing and delivery information. An order confirmation acknowledges receipt of an e-Gift Card order but does not guarantee acceptance. We may hold, review, reject, or cancel an order for payment problems, suspected fraud, misuse, unauthorized resale, or violation of these Gift Card Terms.

If we cancel an e-Gift Card purchase after payment has been processed and before value has been redeemed, we will refund the applicable amount to the original payment method, subject to fraud-prevention requirements and applicable law.

3. Delivery and Scheduled Delivery

The purchaser may choose immediate electronic delivery or, when the option is available, schedule delivery up to 90 days in advance. Scheduled delivery dates are based on the information submitted at checkout and are not guaranteed. Email delivery may be affected by system availability, email providers, spam filters, security settings, or circumstances beyond our reasonable control.

The purchaser is responsible for entering the correct recipient name and email address and reviewing the information before completing the purchase. Healthy Hoohoo is not responsible for an e-Gift Card sent to an incorrect address supplied by the purchaser. If you identify an error, contact us immediately. We will try to help before delivery, but we cannot guarantee that delivery can be changed or stopped.

If an expected e-Gift Card does not arrive, the purchaser or recipient should check spam, junk, promotions, and blocked-sender folders and confirm that emails from Healthy Hoohoo are permitted. For additional help, contact info@healthyhoohoo.com with the purchaser's name, order number, recipient email address, and scheduled delivery date.

4. Redemption and Remaining Balances

Enter the e-Gift Card code in the gift-card field during checkout. The available balance will be applied to eligible products and other eligible order charges. If the order total exceeds the available balance, the remaining amount must be paid with another accepted payment method. If the order total is less than the available balance, the unused balance will remain available on the same e-Gift Card for future eligible purchases.

More than one e-Gift Card may be used on an order only when our checkout permits it. An e-Gift Card cannot be applied to a completed order or exchanged for a different promotion after checkout.

To request balance assistance, contact info@healthyhoohoo.com. For security, we may request information reasonably necessary to verify the purchaser, recipient, transaction, or ownership of the e-Gift Card.

5. Expiration and Fees

Purchased Healthy Hoohoo e-Gift Cards do not expire. We do not charge inactivity, maintenance, or service fees, and an e-Gift Card balance will not decrease because of the passage of time or lack of use.

Separate terms may apply to promotional credits, discount codes, free gift cards, or other value issued without full payment, to the extent permitted by law. Any such expiration or limitation will be disclosed with the applicable promotion.

6. Cash Redemption

Except as required by law, e-Gift Cards are not redeemable for cash or cash equivalents.

For consumers entitled to Oregon's statutory cash-redemption right, a purchased e-Gift Card that has been used for at least one purchase may be redeemed for cash when its remaining value is less than $5, subject to applicable statutory exceptions. To request a legally required cash redemption, contact info@healthyhoohoo.com. We may require reasonable verification and will provide payment using a method permitted by law.

Other jurisdictions may provide additional cash-redemption rights, which we will honor where applicable.

7. Refunds and Returns

The purchase of an e-Gift Card is final and non-refundable except where required by law or where we cancel the purchase before redemption.

Products purchased using an e-Gift Card remain subject to our Refund Policy. When a refund is approved for a purchase paid wholly or partly with an e-Gift Card, the applicable amount will generally be returned to an e-Gift Card or store balance rather than paid in cash, unless required otherwise by law. If multiple payment methods were used, we may allocate the refund among those methods based on the original transaction.

8. Promotions and Purchase Thresholds

Unless an offer expressly states otherwise:

• promotional discounts, coupon codes, store credits, and other offers cannot be applied to the purchase of an e-Gift Card;

• e-Gift Card purchases do not count toward minimum-spend requirements for discounts, free shipping, free gifts, rewards, or other promotional benefits; and

• purchasing or redeeming an e-Gift Card does not create an entitlement to a promotion that has ended, reached its redemption limit, or is otherwise unavailable.

The purchase of an e-Gift Card and the later purchase of products using that e-Gift Card are separate transactions for purposes of promotional eligibility.

9. Protecting the e-Gift Card Code

Treat an e-Gift Card code like cash. Anyone who obtains the code may be able to use its value. Do not post, transmit, or disclose the code to anyone you do not trust. Healthy Hoohoo will never ask you to purchase an e-Gift Card to pay a government agency, debt collector, utility, technical-support provider, or another unrelated person or business.

Healthy Hoohoo is not responsible for an e-Gift Card that is lost, stolen, misdirected, disclosed, or used without permission after it has been delivered to the email address provided, except to the extent required by law.

If you believe a code has been compromised, contact us immediately. At our discretion, we may replace the remaining unused balance if you provide satisfactory proof of purchase or ownership and our records can verify that the value has not already been redeemed. We cannot restore value already used by a person who obtained the code unless required by law.

10. Transfers and Resale

An e-Gift Card may be given to an intended recipient as a personal gift. It may not be resold, brokered, exchanged for value, used for commercial purposes, or transferred through an unauthorized marketplace without our written permission. We do not guarantee or provide support for e-Gift Cards obtained from unauthorized sellers or resale platforms.

Restrictions in this section apply only to the extent permitted by law and do not prohibit a lawful personal gift.

11. Fraud, Misuse, and Enforcement

We may delay, refuse, cancel, suspend, or limit the purchase, issuance, delivery, or redemption of an e-Gift Card when we reasonably suspect:

• fraud, theft, money laundering, or unauthorized payment activity;

• acquisition or use through unlawful or unauthorized means;

• alteration, duplication, automated code testing, or attempted circumvention of security controls;

• unauthorized resale or commercial use;

• use in connection with promotion abuse, chargebacks, or another violation of these Gift Card Terms; or

• an error in issuance, value, or delivery.

We may require verification before restoring access or processing a transaction. If an e-Gift Card was obtained lawfully and value remains, we will handle the remaining balance as required by applicable law. We reserve all lawful remedies.

12. Limitation of Liability

To the fullest extent permitted by law, Healthy Hoohoo is not responsible for indirect, incidental, special, or consequential losses arising from delayed or failed email delivery, an incorrect recipient address supplied by the purchaser, loss or disclosure of a code, unauthorized use, or temporary unavailability of the Site or checkout.

Our total liability relating to an e-Gift Card will not exceed the verified unused balance of that e-Gift Card, except where applicable law does not permit that limitation. Nothing in these Gift Card Terms limits rights or liability that cannot legally be limited.

13. Privacy

We process purchaser and recipient information as described in our Privacy Policy. Purchasers should provide a recipient's personal information only when authorized to do so. Gift messages must not contain unlawful, abusive, threatening, defamatory, infringing, or sensitive personal information.

14. Changes to These Gift Card Terms

We may update these Gift Card Terms from time to time by posting a revised version and changing the "Last updated" date. Changes will apply prospectively and will not reduce the value of an e-Gift Card or retroactively change fee or expiration terms in a manner prohibited by law. We will provide any additional notice required by law.

15. Governing Terms and Disputes

Our general Terms and Conditions, including their governing-law and dispute-resolution provisions, apply to e-Gift Cards and are incorporated into these Gift Card Terms. Nothing here limits consumer protections that cannot be waived.
